Surry County is situated in the foothills of northwestern North Carolina, with Dobson serving as its county seat. The county’s court system operates through both Superior Court and District Court, both housed within the Surry County Courthouse. The Clerk of Superior Court functions as the official custodian of all court records in the county, overseeing criminal, civil, family, estates, and special proceedings files. Surry County falls within Prosecutorial District 23, Superior Court District 23, and District Court District 23.

Residents and members of the public looking for court records in North Carolina can take advantage of several official resources. The clerk’s office at the local courthouse maintains paper files and provides public access terminals for searching case information electronically. The state judiciary also operates the eCourts Portal, an online tool that allows anyone to look up case records by party name, case number, citation, or attorney. Additional statewide resources — including forms, filing instructions, and court schedules — are available through NorthCarolinaCourts.us. For those who need ongoing bulk access to court data, the North Carolina Administrative Office of the Courts offers a separate licensing program.

Are Court Records Public in Surry County?

Court records in Surry County are generally open to the public under the North Carolina Public Records Law (Chapter 132). This statute classifies documents created or maintained by government agencies — including the courts — as public records, meaning they must be made available for inspection and copying upon request. There is no requirement that a requester state why they need a record or prove residency in North Carolina.

However, the law recognizes several categories of information that are protected from public disclosure, either by statute or by court order. Records that may be restricted or sealed in Surry County include:

  • Expunged records — criminal records that have been formally erased pursuant to a court order of expunction
  • Sealed records — files that a judge has ordered sealed to protect privacy or the integrity of proceedings
  • Juvenile records — court records involving minors, which are confidential by statute
  • Trade secrets — proprietary business information introduced during litigation
  • Personal identifiers — Social Security numbers, financial account numbers, and passwords contained within court filings
  • Law enforcement investigative techniques — details that could compromise ongoing or future investigations
  • Protected health information — medical records or mental health details filed in connection with court proceedings

N.C. General Statute § 132-1.4 specifically addresses criminal court records, confirming that returned arrest and search warrants, indictments, criminal summons, nontestimonial identification orders, and other specified records are public. However, records of active criminal investigations by law enforcement agencies may be withheld. The Clerk of Superior Court has discretion to redact sensitive personal information before releasing any document.
