  1. Personal review (Right to Review): Individuals can request their own criminal history by submitting a fingerprint-based application. The fee is $14 per request, payable by money order or certified check only. Results are mailed via USPS and processing takes up to 20 business days. Applications must be submitted by mail; there is no in-person or expedited service.
  2. Employer / agency checks: Fingerprint-based state and national checks are available to authorized agencies. The combined state and national fingerprint check costs $38, while a state-only fingerprint check is $14.

Stanly County Civil Court Records

Stanly County Family Court Records

Stanly County operates within the state’s Family Court model, which consolidates family-related legal matters for more coordinated case management. The Family Court Administration coordinates services for cases involving divorce, child custody and visitation, child support, equitable distribution, domestic violence, juvenile delinquency, and abuse and neglect proceedings.

Divorce Records

Divorce cases in North Carolina are filed in the District Court. The Clerk of Superior Court maintains all divorce records for Stanly County. Copies of divorce judgments can be obtained from the clerk’s office in person or by mail for a fee. Certified copies are restricted to the marriage parties, immediate family members, and authorized legal representatives. A valid government-issued photo ID must accompany every request for a certified copy. When requesting by mail, include a self-addressed stamped envelope.

Birth and Death Records

Birth and death certificates are also maintained by the Register of Deeds. Certified copies are $10.00 each; non-certified copies are $0.25. Eligible requesters include the record subject, their spouse, parents, siblings, children, grandchildren, grandparents, stepparents, stepchildren, authorized agents, and the individual’s attorney or legal representative. Funeral directors may obtain death certificates. Requests can be made online, in person, or by mail using the paper application form. Alternatively, statewide vital records can be ordered from the North Carolina Division of Vital Records, which holds birth records from 1913 and death records from 1930.

Stanly County Probate Court Records

North Carolina does not have a separate probate court. Instead, probate and estate matters are handled by the Clerk of Superior Court, who sits as a judicial officer for these proceedings. In Stanly County, the Clerk of Superior Court at the Stanly County Courthouse administers estates, probates wills, appoints executors and administrators, oversees guardianship and conservatorship cases, and manages related special proceedings.

Types of Probate Records

Probate records maintained by the clerk’s office include wills, letters testamentary, letters of administration, estate inventories, annual accountings, final accountings, guardianship and conservatorship petitions, appointment orders, and distribution documents.

Estate Filing Fees

Estate filing fees in North Carolina are set by statute under G.S. 7A-307. The filing fee to open an estate is $120. In addition, an estate administration tax of $0.40 per $100 of the gross estate value is assessed, with a minimum fee of $15 and a maximum of $6,000. Guardianship and Conservatorship

Petitions for guardianship of incompetent adults and minors, as well as conservatorship proceedings, are filed with the Clerk of Superior Court as special proceedings. Confidentiality Considerations

While many probate records are part of the public record, certain proceedings—particularly those involving incompetency determinations and guardianship of minors—may contain restricted information. Individuals should inquire with the clerk’s office about the availability of specific records before visiting. Adoption records, which are also processed through the Clerk of Superior Court as special proceedings, are sealed and not available to the general public.
