Sampson County, North Carolina, maintains an organized court system that produces records across all major areas of law — criminal, civil, family, and probate. These records are official documents generated during legal proceedings and can take many forms, including motions, pleadings, orders, judgments, exhibits, transcripts, and docket entries. Under the North Carolina Public Records Law (N.C.G.S. Chapter 132), court records are broadly considered public property, and citizens have legal standing to request them from the relevant government agencies.

Individuals researching court cases in North Carolina have multiple avenues for locating records — through clerk’s offices, in-person public access terminals at courthouses, mail requests, and online tools. NorthCarolinaCourts.us may assist in locating publicly available court case information from across the state, including cases filed in Sampson County. For a comprehensive search, users are encouraged to start with the clerk’s office in the county where the case was originally filed.

Are Court Records Public in Sampson County?

North Carolina law establishes a clear presumption that court records are public. N.C.G.S. Chapter 132 declares that public records are “the property of the people”, and government agencies holding such records are required to make them available to any person upon request. This principle applies to most Sampson County court filings, including civil complaints, criminal case dockets, judgments, and orders.

However, certain records are sealed, restricted, or exempt from public access. Under N.C.G.S. § 132-1.49(k) and related statutes, the following types of records are shielded from general public inspection:

  • Juvenile dependency and delinquency records
  • Arrest records of individuals determined to be factually not guilty
  • Subpoenaed records
  • Arrest records returned by indictments, criminal nontestimonial identification orders, and summons
  • Records containing an individual’s social security number

Additionally, courts may restrict access to specific documents by court order. Confidential proceedings — such as involuntary hospitalization hearings — require special permission to obtain audio recordings, which must be requested using Form AOC-G-115. For non-confidential proceedings, audio recording copies may be requested using Form AOC-G-114. Expungement under Article 5, N.C.G.S. § 15A-145 may remove certain criminal records from public access entirely.

Requests for in-person inspection of court records are accepted at the Sampson County Clerk of Superior Court’s office during regular courthouse hours. Staff can provide certified copies of documents, with copy fees applicable at the time of request.
