How to Look Up a Court Case in Rutherford County?

Methods for Searching Court Records

  1. In person at the courthouse. Visit the Clerk’s office during business hours to review paper case files or use the public self-service computer terminals. Terminals allow searches by defendant name, case number, or victim/witness name for criminal cases, and by party name or case number for civil and estate matters. No charge applies for searching; printing and copy fees are assessed separately.
  2. Online through the NC Courts Portal. The Judicial Branch’s Portal provides free public access to case information statewide. Users can search by name, case number, citation number, county, or attorney. The Portal displays docket entries, hearing dates, and case status. Note that the Judicial Branch advises against using the Portal for formal background checks—those should be conducted through the Clerk’s office.
  3. By mail through the NCAOC. The North Carolina Administrative Office of the Courts accepts written public records requests. Send the request form to: Public Records Request, P.O. Box 2448, Raleigh, NC 27602. Copies cost $0.25 per page.
  4. Court calendars. Upcoming hearing dates for civil and criminal matters can be viewed on the Judicial Branch website through the civil court calendars page, where users can filter by county.

Are Court Records Public in Rutherford County?

North Carolina treats court records as presumptively open to the public. The Public Records Act (N.C.G.S. § 132-1) defines public records broadly, encompassing all documents, papers, letters, maps, photographs, films, recordings, and digital data created or received by any government agency—including courts—in connection with public business. This statute guarantees that most court records in Rutherford County are accessible to any person who requests them, subject to certain narrowly defined exceptions.

The North Carolina Judicial Branch publishes a list of protected and exempted records that are shielded from public disclosure. Categories of records that are restricted or confidential include:

Rutherford County Criminal Court Records

Criminal cases in Rutherford County are heard in both Superior Court and District Court, depending on the severity of the offense. Felony cases are tried in Superior Court, while misdemeanors and infractions are generally handled in District Court. The Clerk of Superior Court maintains records for all criminal cases regardless of the court level.

A certified, single-county criminal record search can be requested through the Clerk’s office using Form AOC-CR-314. This search covers only Rutherford County court records and costs $25.00. Requests can be submitted in person (with payment by credit card, cash, money order, or certified check) or by mail (money order or certified check only). This is the method recommended by the Judicial Branch for formal background checks.

Statewide Criminal History through the SBI

For a comprehensive review of an individual’s own North Carolina criminal record, the State Bureau of Investigation offers a fingerprint-based statewide search. The process requires submission of a completed “Right to Review” form, a fingerprint card, and a $14.00 fee (money order or certified check). Forms are available on the SBI website. This search produces a non-certified report covering all records maintained in the SBI’s statewide repository.

Sheriff’s Office

The Rutherford County Sheriff’s Office is the primary law enforcement agency in the county and produces many of the arrest and incident reports that feed into the court system.

Requests for arrest records or police reports should be directed to the Sheriff’s Office. Complete reports may not be available as public records in all circumstances—particularly if an investigation is ongoing or if discovery rules in a criminal case restrict disclosure.

Rutherford County Civil Court Records

Each filing fee includes the General Court of Justice fee, facilities fee, and telecommunications/data connectivity fee. A $30.00 service fee is assessed for each item of civil process served by the Sheriff (G.S. 7A-311(a)(1)). Additional fees include $15.00 for alias and pluries summons, $75.00 for filing for absolute divorce, and $20.00 for each motion/notice of hearing (G.S. 7A-305(f)).

Searching Civil Records

Civil case information can be accessed through the public self-service terminals at the courthouse or through the online Portal. The Judicial Branch provides a user manual for the Civil Case Processing System (VCAP) to assist users navigating the self-service terminals. Paper files are available for review at the Clerk’s office, and copies can be made at the standard per-page rates ($2.00 first page, $0.25 each additional).

Property Records

Court-related property records—including foreclosures, evictions, partitions, condemnations, judgments, and liens on real property—are maintained by the Clerk. Non-court property documents such as deeds, mortgages, and plats are recorded with the Rutherford County Register of Deeds. The Register of Deeds office offers an online land records search portal, and the county’s GIS website provides free parcel mapping. Tax assessment data and property record cards are available through the Revenue Department’s online system.

Rutherford County Family Court Records

Family law cases in Rutherford County—including divorce, child custody, child support, domestic violence protective orders, and adoption—are heard in District Court. The Clerk of Superior Court’s office maintains all family law case files, and records can be searched through the same courthouse terminals and online Portal used for other case types.

Divorce Records

North Carolina requires that an action for absolute divorce be filed in the county where at least one spouse resides. In Rutherford County, divorce case records are filed with and maintained by the Clerk of Superior Court. To obtain a certified copy of a divorce judgment, contact the Clerk’s office and provide the full names of both parties, the approximate date of the divorce, and any available case number. The filing fee for absolute divorce is $75.00 (in addition to the District Court base filing fee of $150.00), and standard copy fees apply for obtaining certified copies of the judgment.

Divorce verification certificates can also be obtained from North Carolina Vital Records for divorces granted from 1958 forward. Multiple ordering options are available, including online through VitalChek, by mail, or in person.

Marriage Licenses and Certificates

Marriage licenses are issued by the Rutherford County Register of Deeds. The license fee is $60.00, there is no waiting period, and the license is valid for sixty days from the date of issuance.

Certified copies of marriage certificates are available from the Register of Deeds for marriages that took place in Rutherford County. Records date back to 1867. Eligible requesters—including the spouses, parents, grandparents, siblings, children, grandchildren, authorized agents, attorneys, and legal representatives—may obtain a certified copy for $10.00. A photo ID is required. Requests can be submitted online, in person, or by mail using the Vital Record Request form. Anyone may obtain a non-certified photocopy for $1.00 by mail.

Birth and Death Records

The Register of Deeds maintains birth records from 1913 to the present and death records from 1913 to the present for events that occurred in Rutherford County. Certified copies cost $10.00 each, and informational (non-certified) copies are $1.00. Requests require a completed Vital Record Request form, a copy of the requester’s photo ID, and payment by check or money order payable to the Register of Deeds. Birth certificates from 1913 forward and death certificates from 1930 forward are also available from the North Carolina Vital Records office, which accepts online, phone, mail, and in-person requests.

Domestic Violence and Custody Programs

Rutherford County participates in several court-administered family programs, including the Child Custody and Visitation Mediation Program, the Family Financial Settlement Program, and the Guardian ad Litem program. No filing fees are assessed for protective order petitions filed under Chapter 50B (domestic violence) or Chapter 50C (civil no-contact orders), per G.S. 50B-2(a).

Rutherford County Probate Court Records

In North Carolina, probate and estate matters are handled by the Clerk of Superior Court rather than a separate probate court. The Clerk in Rutherford County oversees the probate of wills, appointment of executors and administrators, guardianship proceedings, estate accountings, and the distribution of assets. Searching Probate Records

Estate case files can be searched at the courthouse using the public self-service terminals or by visiting the Clerk’s office and requesting access to specific files. The online Portal also provides access to estate case data by name or case number. The Judicial Branch provides general guidance on wills and estates procedures, including information about the types of estate proceedings available under North Carolina law.

Requesting Copies

To obtain copies of probate filings—such as wills, letters testamentary, inventories, or accountings—visit the Clerk’s office or submit a written request by mail. Provide the decedent’s full name, the case number if known, and a description of the documents needed. Standard copy fees apply: $2.00 for the first page of each document and $0.25 for each additional page, plus $3.00 for certification under seal if a certified copy is required.

Guardianship

Guardianship proceedings for incapacitated adults and minors are also administered through the Clerk’s office as part of the estates/special proceedings docket. The county participates in the Judicial Branch’s Clerk Mediation Program, which may be used to resolve disputes in guardianship and estate matters without a full hearing.
