How to Look Up a Court Case in Halifax County?
Halifax County court cases can be searched through online tools, in-person visits, and written requests. The method you choose may depend on whether you need certified copies, informal case information, or detailed documents from a court file.
Online Case Search
Since Halifax County completed its eCourts conversion in April 2025, case information is accessible through the North Carolina Judicial Branch’s Portal. Users can search by party name, attorney, case number, citation number, and other criteria. Portal provides access to docket entries, hearing dates, and case status information. However, the NC Judicial Branch advises that individuals performing formal background checks should use the clerk’s office rather than Portal.

Requesting Copies
Staff at the Clerk’s Office can provide copies of documents from court files for a fee. For a certified criminal background check in a single county, complete Form AOC-CR-314 and submit it to the Clerk’s Office with the $25.00 fee. Payment by mail must be made via money order or certified check (personal checks are not accepted). In-person payments can be made by credit card, cash, money order, or certified check.
Audio Recordings of Court Proceedings
If a court hearing was recorded, you can request a copy of the audio recording from the Clerk’s Office. For non-confidential cases, submit Form AOC-G-114. For confidential proceedings (such as juvenile cases), use Form AOC-G-115 to request court permission. A fee for the actual cost of the CD applies.
Are Court Records Public in Halifax County?
Under the North Carolina Public Records Law (G.S. Chapter 132), most court records in Halifax County are public and available for inspection. G.S. 132-1.4(a) specifically identifies several categories of court records as public, including returned arrest and search warrants, unless sealed by court order.

Searching Criminal Records
Criminal case information can be searched at no charge on public-access terminals at any North Carolina courthouse. The eCourts Portal also provides online access to criminal case data for Halifax County. Halifax County Civil Court Records
Civil disputes in Halifax County are heard in either the Superior Court or the District Court depending on the amount in controversy. The Superior Court handles civil cases with claims exceeding $25,000, while the District Court hears civil matters with claims of $25,000 or less, including small claims, summary ejectment (eviction), and landlord-tenant disputes. Adoption and Juvenile Records
Adoption records in Halifax County are sealed and not available for public inspection. Juvenile proceedings — including delinquency, undisciplined juvenile matters, and abuse, neglect, and dependency cases — are generally confidential under G.S. Chapter 7B. Marriage Records
Marriage licenses are issued by the Halifax County Register of Deeds. Requests require a valid state or federal photo ID. Payment is accepted in cash or money order (no personal checks for vital records); debit and credit cards are also accepted. If ordering online, a convenience fee applies. For records not available locally, the North Carolina Office of Vital Records maintains statewide birth records from 1913 and death records from 1930.
Birth and Death Records
Birth and death certificates in Halifax County are available from the Register of Deeds office. Under North Carolina law, vital records are not free public records, and access is limited to authorized individuals, including the registrant (for birth certificates), immediate family members, legal guardians, funeral directors (for death certificates), and authorized legal representatives. Out-of-county birth certificates for births that occurred anywhere in North Carolina since 1971 can be obtained in person at the Halifax County Register of Deeds through the state’s electronic birth registration system.
