Are Court Records Public in Granville County?
Court records in Granville County are presumed open to the public under the North Carolina Public Records Law (Chapter 132) of the General Statutes. This law affirms the right of any person to inspect and obtain copies of public records, including most documents held by the courts. At the same time, the statute recognizes categories of records that must remain confidential in the interest of justice, privacy, or public safety.
Records that are generally confidential include:
- Adoption case files
- Juvenile court records, including abuse, neglect, and dependency reports
- Mental health commitment proceedings
- Grand jury proceedings
- Judges’ internal notes, drafts, and communications with law clerks
- Confidential communications between government attorneys and their clients
- Criminal investigation records maintained by law enforcement (subject to specific rules under N.C.G.S. § 132-1.4)
- Arrest and search warrants that have not yet been returned
- Settlement records in medical malpractice actions against public hospitals
- Court officials’ personal and personnel records
Arrest and search warrants become public records once they have been executed and returned to the court. Records in confidential case types — such as juvenile and involuntary commitment cases — are accessible only to the parties involved and may require a court order for release to anyone else. If a court hearing involved a confidential proceeding, even audio recordings require judicial permission; a request must be filed using Form AOC-G-115.
For non-confidential audio recordings of court proceedings, use Form AOC-G-114 and submit it to the Clerk of Court in the county where the hearing took place. A fee for the cost of the CD applies.
